WebRecon’s latest report shows litigation increased in January across the board for Fair Debt Collection Practices Act, Fair Credit Reporting Act and Telephone Consumer Protection Act claims.
FDCPA suits increased 24.1% from December 2023 to January 2024, TCPA cases increased 78.6%, FCRA cases increased 23.8%, and CFPB complaints increased 14.8%, according to WebRecon findings.
Here is a breakdown of claims under accounts receivable management industry laws as well as CFPB complaints for January 2024.
Fair Debt Collection Practices Act
FDCPA claims increased by 24.1% to 453 in January compared to 365 in December. Compared to claims from Jan. 1 through Jan. 31, 2023, FDCPA claims increased 30.5%, from 347 to 453, during the same period in 2024.
Telephone Consumer Protection Act
TCPA claims increased 78.6%, with 200 claims in January compared to 112 in December. Compared to claims from Jan. 1 through Jan. 31, 2023, TCPA claims increased 50.4%, from 133 to 200, during the same period in 2024.
Fair Credit Reporting Act
FCRA claims increased by 23.8% to 530 in January compared to 428 in December. Compared to claims from Jan. 1 through Jan. 31, 2023, FCRA claims decreased 19.6%, from 443 to 530, during the same period in 2024.
Consumer Financial Protection Bureau Complaints
Consumer complaints filed with the CFPB increased by 14.8% to 6,947 in January compared to 6,051 in December.
There were 6,079 complaints in January 2023 compared to the 6,947 complaints in January 2024—a 14.3% increase.
The types of debt behind the complaints were:

1,203 Other debt (17%)
522 Medical debt (8%)
470 Rental debt (7%)
437 Telecommunications debt (6%)
356 Auto debt (5%)
140 Payday loan debt (2%)
64 Mortgage debt (1%)
59 Federal student loan debt (1%)
36 Private student loan debt (1%)
The most common type of complaint was about attempts to collect debt not owed, at 52% or 3,599 complaints, followed by complaints about written notification about a debt at 24% or 1,699.
