Litigation was down for FDCPA and TCPA claims, according to the latest report from WebRecon.

WebRecon’s latest report shows litigation decreased again in September in Fair Debt Collection Practices Act and Telephone Consumer Protection Act claims, but increased in Fair Credit Reporting Act claims.
FDCPA suits decreased 4.8% from August 2023 to July 2023, TCPA cases decreased 1.9%, FCRA cases increased 6.5%, and CFPB complaints decreased 17.6%, according to WebRecon findings.
Here is a breakdown of claims under accounts receivable management industry laws as well as CFPB complaints for September 2023.
Fair Debt Collection Practices Act
FDCPA claims decreased by 4.8% to 360 in September compared to 378 in August. Compared to claims from Jan. 1 through Sept. 30, 2022, FDCPA claims declined 18.1%, from 3,685 to 3,019, during the same period in 2023.
Telephone Consumer Protection Act
TCPA claims decreased 1.9%, with 155 claims in September claims to 158 claims in August. Compared to claims from Jan. 1 through Sept. 30, 2022, TCPA claims increased 13.1%, from 1,171 to 1,324, during the same period in 2023.
Fair Credit Reporting Act
FCRA claims increased by 6.5% to 526 in September compared to 494 in August. Compared to claims from Jan. 1 through Sept. 30, 2022, FCRA claims decreased 3.7%, from 4,337 to 4,176, during the same period in 2023.
Consumer Financial Protection Bureau Complaints
Consumer complaints filed with the CFPB decreased by 17.6% to 4,849 in September compared to 5,885 in August.
There were 4,577 complaints in September 2022 compared to the 4,849 complaints in September 2023—a 5.9% increase.
The types of debt behind the complaints were:
1,258 I do not know (26%)
1,126 Credit card debt (23%)
747 Other debt (15%)
504 Medical debt (10%)
434 Telecommunications debt (9%)
368 Rental debt (8%)
212 Auto debt (4%)
108 Payday loan debt (2%)
34 Mortgage debt (1%)
31 Private student loan debt (1%)
27 Federal student loan debt (1%)
The most common type of complaint was about attempts to collect debt not owed, at 55% or 2,674 complaints, followed by complaints about written notification about a debt at 18% or 851.
