Litigation was up for FCRA claims, but down for FDCPA and TCPA claims, according to the latest report from WebRecon.

WebRecon’s latest report shows litigation decreased in November for Fair Debt Collection Practices Act and Telephone Consumer Protection Act claims, but increased for Fair Credit Reporting Act claims.
FDCPA suits decreased 11.6% from October 2023 to November 2023, TCPA cases decreased 9.3%, FCRA cases increased 2.7%, and CFPB complaints decreased 2.7%, according to WebRecon findings.
Here is a breakdown of claims under accounts receivable management industry laws as well as CFPB complaints for November 2023.
Fair Debt Collection Practices Act
FDCPA claims decreased by 11.6% to 366 in November compared to 414 in October. Compared to claims from Jan. 1 through Nov. 30, 2022, FDCPA claims declined 10.3%, from 4,236 to 3,800, during the same period in 2023.
Telephone Consumer Protection Act
TCPA claims decreased 9.3%, with 117 claims in November compared to 129 claims in October. Compared to claims from Jan. 1 through Nov. 30, 2022, TCPA claims increased 8.9%, from 1,443 to 1,571, during the same period in 2023.
Fair Credit Reporting Act
FCRA claims increased by 2.7% to 498 in November compared to 485 in October. Compared to claims from Jan. 1 through Nov. 30, 2022, FCRA claims decreased 0.3%, from 5,177 to 5,159, during the same period in 2023.
Consumer Financial Protection Bureau Complaints
Consumer complaints filed with the CFPB decreased by 2.7% to 5,382 in November compared to 5,529 in October.
There were 4,395 complaints in November 2022 compared to the 5,382 complaints in November 2023—a 22.5% increase.
The types of debt behind the complaints were:

1,276 Credit card debt (24%)
721 Other debt (13%)
431 Telecommunications debt (8%)
419 Medical debt (8%)
379 Rental debt (7%)
265 Auto debt (5%)
98 Payday loan debt (2%)
88 Mortgage debt (2%)
42 Federal student loan debt (1%)
29 Private student loan debt (1%)
The most common type of complaint was about attempts to collect debt not owed, at 84% or 2,604 complaints, followed by complaints about written notification about a debt at 26% or 1,383.
