Litigation was up again for FDCPA, TCPA and FCRA claims, according to the latest report from WebRecon.

WebRecon’s latest report shows litigation increased again in August in Fair Debt Collection Practices Act, Telephone Consumer Protection Act and Fair Credit Reporting Act claims.
FDCPA suits increased 15% from July 2023 to August 2023, TCPA cases increased 5.3%, FCRA cases increased 6.5%, and CFPB complaints increased 4.1%, according to WebRecon findings.
Here is a breakdown of claims under accounts receivable management industry laws as well as CFPB complaints for August 2023.
Fair Debt Collection Practices Act
FDCPA claims increased by 15% to 376 in August compared to 327 in July. Compared to claims from Jan. 1 through Aug. 31, 2022, FDCPA claims declined 21.4%, from 3,377 to 2,655, during the same period in 2023.
Telephone Consumer Protection Act
TCPA claims increased 5.3%, with 158 claims in August compared to 150 in July. Compared to claims from Jan. 1 through Aug. 31, 2022, TCPA claims increased 31.2%, from 1,033 to 1,169, during the same period in 2023.
Fair Credit Reporting Act
FCRA claims increased by 6.5% to 492 in August compared to 452 in July. Compared to claims from Jan. 1 through Aug. 31, 2022, FCRA claims decreased 5.8%, from 3,868 to 3,644, during the same period in 2023.
Consumer Financial Protection Bureau Complaints
Consumer complaints filed with the CFPB increased by 4.1% to 5,692 in August compared to 5,470 in July.
There were 5,009 complaints in August 2022 compared to the 5,692 complaints in August 2023—a 13.6% increase.
The types of debt behind the complaints were:

1,434 I do not know (25%)
1,430 Credit card debt (25%)
572 Medical debt (10%)
280 Auto debt (5%)
126 Payday loan debt (2%)
113 Telecommunications debt (2%)
90 Rental debt (1%)
68 Mortgage debt (1%)
46 Federal student loan debt (1%)
28 Private student loan debt (0%)
The most common type of complaint was about attempts to collect debt not owed, at 54% or 3,096 complaints, followed by complaints about written notification about a debt at 17% or 952.
