Consumer preference and the use of modern communications addressed in part one of the Consumer Financial Protection Bureau’s final debt collection rule dominated discussion Monday in the fourth part of the ACA Huddle CFPB Rule Series.
ACA International members Leslie Bender, IFCCE, CCCO, senior counsel at Clark Hill PLC, David Schultz, partner at Hinshaw & Culberston LLP, and Tim Collins, general counsel and chief compliance officer at TrueAccord Corp., led the ACA Huddle on electronic communications disclosures.
Collins, Bender and Schultz reviewed the rule’s provisions on email, social media communications, reinforcement of letter communications and what members need to balance to remain compliant with the Telephone Consumer Protection Act as well as how part one of the CFPB rule provides new clarity on Fair Debt Collection Practices Act guardrails as they apply to more modern versions of communications.
Part two of the rule will be focused on additional disclosures and is slated for release in December 2020.
While several of ACA’s supported issues were included in the CFPB’s final debt collection rule, some were not, and ACA will continue to highlight to the bureau areas that need to be improved upon, ACA previously reported. ACA’s review of the rule shows itremoves opaque restrictions that were proposed concerning communicating in unusual or inconvenient times or places, also discussed during the ACA Huddle on electronic communications.
