Litigation was down for FCRA, FDCPA and TCPA claims, according to the latest report from WebRecon.

WebRecon’s latest report shows that for the first time since June 2023, litigation decreased in December across the board for Fair Debt Collection Practices Act, Fair Credit Reporting Act and Telephone Consumer Protection Act claims.
FDCPA suits decreased 0.3% from November 2023 to December 2023, TCPA cases decreased 4.3%, FCRA cases decreased 14.1%, and CFPB complaints increased 9.4%, according to WebRecon findings.
Here is a breakdown of claims under accounts receivable management industry laws as well as CFPB complaints for December 2023.
Fair Debt Collection Practices Act
FDCPA claims decreased by 0.3% to 365 in December compared to 366 in November. Compared to claims from Jan. 1 through Dec. 31, 2022, FDCPA claims declined 8.2%, from 4,535 to 4,165, during the same period in 2023.
Telephone Consumer Protection Act
TCPA claims decreased 4.3%, with 112 in December compared to 117 claims in November. Compared to claims from Jan. 1 through Dec. 31, 2022, TCPA claims increased 9.4%, from 1,539 to 1,683, during the same period in 2023.
Fair Credit Reporting Act
FCRA claims decreased by 14.1% to 428 in December compared to 498 in November. Compared to claims from Jan. 1 through Dec. 31, 2022, FCRA claims decreased 0.9%, from 5,635 to 5,587, during the same period in 2023.
Consumer Financial Protection Bureau Complaints
Consumer complaints filed with the CFPB increased by 9.4 % to 5,954 in December compared to 5,444 in November.
There were 4,839 complaints in December 2022 compared to the 5,954 complaints in December 2023—a 23% increase.
The types of debt behind the complaints were:

1,452 Credit card debt (24%)
697 Other debt (12%)
459 Medical debt (8%)
427 Rental debt (7%)
416 Telecommunications debt (7%)
305 Auto debt (5%)
114 Payday loan debt (2%)
58 Mortgage debt (1%)
52 Federal student loan debt (1%)
40 Private student loan debt (1%)
The most common type of complaint was about attempts to collect debt not owed, at 48% or 2,854 complaints, followed by complaints about written notification about a debt at 27% or 1,616.
