O’Rielly will discuss the landscape of the law after the U.S. Supreme Court heard oral arguments in a case debating constitutionality of content restrictions in automated calls.

FCC Commissioner Michael O’Rielly Joins Panel on TCPA Case

ACA International members interested in the ongoing Barr v. American Association of Political Consultants case that could have implications for language in the Telephone Consumer Protection Act should join an online discussion featuring Federal Communications Commissioner Michael O’Rielly Tuesday, May 26.

The U.S. Supreme Court—via teleconference—debated the constitutionality of content restrictions in automated calls to cell phones and a federal exception for calls to collect government debt in an hour-long hearing May 6., ACA previously reported.

The case, Barr v. American Association of Political Consultants turns on whether the government-debt exception to the TCPA automated call restriction violates the First Amendment and, if so, whether the proper remedy would be to sever the exception from the remainder of the statute.

In “A Conversation with FCC Commissioner Michael O’Rielly: The Telephone Consumer Protection Act Landscape after Barr v. American Association of Political Consultants,” hosted by The Federalist Society, O’Rielly and Wiley Rein partner Scott Delacourt will discuss the implications of the case within the broader TCPA landscape, including the nationwide circuit split on interpreting “automatic telephone dialing system” and the FCC’s role in resolving ongoing legal and regulatory uncertainty.
