Bankruptcy filings have been on the rise, and with the increasing number of consumers seeking debt relief, it’s essential for collection agencies and law firms to navigate the complexities of consumer collection within the realm of bankruptcy.
To shed light on this topic, Bassford Remele shareholders Jessica Klander and Patrick Newman will be hosting an informative continuing legal education (CLE) session at ACA’s 2023 Convention & Expo, Thursday, July 27.
The session, Building on Bankruptcy Basics: Bonding Over the Bankruptcy Code, promises to provide attendees with invaluable insights, practical strategies and best practices to effectively manage the challenges presented by Chapter 7 and 13 bankruptcy filings.
“U.S. bankruptcy filings surged in the first half of 2023, and economists are forecasting that the number of bankruptcy filings will continue to increase,” Klander said. “With Fair Debt Collection Practices Act lawsuits down, the plaintiffs’ bar is looking for viable cases to fill their plates. Amidst this landscape, it is pretty likely we will start seeing more bankruptcy-related claims against collection agencies and law firms. This session will cover the common claims and trip wires when collecting on debts from consumers in (or about to be in) bankruptcy, as well as the best practices needed to protect your business against potential claims.”
In addition to exploring defense and settlement considerations for claims during bankruptcy and addressing the approach to debt collection after dismissal, this session emphasizes leveraging policies and procedures to establish a bona fide error defense for automatic stay and discharge injunction claims.
While this session is specifically designed for attorneys seeking their CLE requirements, Klander says it is also great for those in compliance, regulatory and legal-related .
