Several states had ballot initiatives that brought voters to the polls Nov. 3, the most important for the accounts receivable management industry being Proposition 24 in California, which amends and strengthens the California Consumer Privacy Act (CCPA) to provide additional requirements regarding service providers’ use of consumer data, spell out provisions for sensitive information and establish a California Privacy Protection Agency, among other things.
At press time, it appears the proposition, called the California Privacy Rights and Enforcement Act (CPREA) passed, according to The Sacramento Bee.
The CPREA also establishes a new state agency to enforce privacy law.
In strengthening the CCPA, the act voted on Nov. 3 may itself only be amended through a future ballot initiative, ACA International previously reported in Collector magazine.
This makes it complicated to change if businesses identify a loophole or unworkable issue down the road or as technology changes. The CPREA takes effect in January 2023.
