When a defendant opposing remand of an FDCPA case argued that a consumer suffered a concrete injury and so had Article III standing, the court rejected this argument because it contradicted the defendant’s affirmative defense that the plaintiff had not suffered an injury-in-fact and so lacked standing to bring her claim.
