One of ACA International’s Member Attorney Program state chairs, Caren Enloe, is taking on a new role following appointment as chair of the Debt Collection Practices and Bankruptcy Subcommittee of the Consumer Financial Services Committee of the Business Law Section of the American Bar Association (ABA).
Enloe is a partner at member company Smith Debnam.
The ABA subcommittee focuses on consumer debt collection practices and the aspects of bankruptcy which affect consumer financial services, including monitoring developments under the federal Fair Debt Collection Practices Act and state laws regulating the collection of debts, according to a news release. The subcommittee also reports on several developing consumer bankruptcy areas, including the proposed amendments to the bankruptcy code, the interaction between reaffirmation, repossession and the discharge injunction, and the use of class actions in bankruptcy courts.
Outside of serving on the subcommittee, Enloe leads Smith Debnam’s consumer financial services litigation and compliance group in defending consumer financial service providers and members of the collection industry in state and federal court, as well as in regulatory matters involving a variety of consumer protection laws. She is a member of the Defense Bar for the National Creditors Bar Association, the North Carolina State Chair for ACA International’s Member Attorney Program and a member of the Bank Counsel Committee of the North Carolina Bankers Association.
