The Tennessee Collection Service Board has voted to approve new rules regarding solicitor cards and renewal fees established at a rulemaking hearing on April 13, 2022. These rules were filed with the Secretary of State on Aug. 1, 2022, and will go into effect on Oct. 30, 2022.
The proposed rules are in response to statutory changes made with the passage of Public Chapter 549 in 2021.
Specifically, Tenn. Code Ann. Section 62-20-102(7) defined “solicitor” and 62-20-111 required solicitors to register for solicitor cards to conduct collection services. Solicitor cards acted as an additional registration requirement and required an additional fee. Effective Oct. 1, 2021, Public Chapter 549 removed “solicitor” from the statutory definitions and deleted 62-20-111 in its entirety, effectively eliminating solicitor cards and associated fees.
Further, Tenn. Code Ann. Section 62-20-105(c) required a licensed collection service maintaining more than one place of business within the state to register each place of business separately as a branch location and to pay a separate fee associated with any registered branch location. Effective Oct. 1, 2021, Public Chapter 549 removed the requirement for branch locations to register for licensure and their associated fees have been removed as a licensing requirement.
