Federal Government Debt Collection Rulemaking
On May 6, 2016, the FCC released a notice of proposed rulemaking to implement a provision in the Bipartisan Budget Act of 2015 that allows autodialed calls “made solely to collect a debt owed to or guaranteed by the United States” from the Telephone Consumer Protection Act’s prior express consent requirement. On Aug. 11, 2016, the FCC released final rules to establish limitations on the exemption, including who can make covered calls, the number of calls that can be made, and to whom the calls may be made, among other things.
