As has become par for the course when tracking consumer litigation filing trends, a lot has changed in the last month as well as in the last year.
“In the month of July 2020, everything was up from June 2020. And everything was down (by double digits, no less!) from last year July,” WebRecon CEO Jack Gordon said in the report. “And, in the (year-to-date) category we have a split decision, with CFPB complaints and FDCPA down, and FCRA and TCPA up.”
Looking at the Monthly Numbers
TCPA filings increased 28.3% from 184 in June to 236 in July, according to the report.
Meanwhile, FDCPA cases increased 0.2% percent from 630 in June to 631 in July, and FCRA cases increased 17.5% from 371 in June to 436 in July.
Year-to-Date Filings
Gordon reports litigation filings declined, comparing July 2019 to July 2020.
The FDCPA declined 10.7% from 707 filings in July 2019 to 631 in July 2020; the FCRA declined 15.2% from 514 in July 2019 to 436 in July 2020; and the TCPA declined 21.9% from 302 in July 2019 to 236 in July 2020.
Overall, there were 2,893 filings for the FCRA from Jan. 1 through July 31, 2019, compared to 3,005 from Jan. 1 through July 31, 2020, an 3.9% increase, according to the report.
TCPA filings increased 12% comparing data from Jan. 1 through July 31, 2019, to that same timeframe this year. There were 2,095 and 2,346 filings under the TCPA, respectively.
The 16.1% decrease in FDCPA filings comparing Jan. 1 through July 31, 2019, to that time this year is 5,104 to 4,283, respectively.
Complaints to the Consumer Financial Protection Bureau increased 7.9% from June to July this year. Year-to-date complaints declined by 8%. Timely responses from financial services companies continue to come in at strong rate: 97%.
