Texas Legislators Propose New State Data Privacy Laws
The proposed bills, like the California Consumer Privacy Act that will take effect next year, would create additional requirements at some businesses collecting and storing consumers’ data.

Texas is one of the latest states to see proposed legislation related to consumer privacy and protection, Ballard Spahr LLP reports in an article for its CyberAdviser blog.
The Texas Consumer Privacy Act (Texas CPA), H.B. No. 4518, and the Texas Privacy Protection Act, (TPPA), H.B. 4390, “bear a strong resemblance” to the California Consumer Privacy Act, which takes effect in January 2020.
According to Ballard Spahr, the proposed Texas CPA if adopted, would take effect Sept. 1, 2020, and generally “applies to companies that do business and collect consumer data.”
“The Texas CPA would also apply to entities owned by companies that would be subject to the law. Similar to the California CPA, the Texas CPA contains express provisions governing rulemaking, implementation, and enforcement of the law,” Ballard Spahr reports.
The proposed legislation focuses on consumer rights such as the right to disclosure of personal information collected by a business and a consumer’s right to have the information collected by the business removed.
The second proposed legislation in Texas, the TPPA, focused on regulations on how a business manages and retains (or deletes) consumers’ personal identifying information. If approved, it would go into effect in September 2019.
