The Consumer Financial Protection Bureau has released its long-awaited debt collection rule. The release of the final rule signals the biggest development in the accounts receivable management (ARM) industry since passage of the Fair Debt Collection Practices Act more than 40 years ago.
ACA’s panel of experts is reviewing the comprehensive rule and will be providing detailed analysis and compliance resources.

Here is a look at the first webinar in the series, Ready, Set . . . Go! Everything You Need to Know About the CFPB’s New Debt Collection Rule, and its speakers. Jonathan Pompan, partner and co-chair of the consumer financial services practice group and CFPB task force at Venable LLP also recently joined the panel of speakers. The webinar will be at 2 p.m. CST, Monday, Nov. 2.
Brian Johnson, who shares a strong acumen on federal oversight and regulation with his experience as deputy director of the CFPB and as a senior counsel on Capitol Hill, will be featured as a special guest during the webinars. Johnson is a partner in Alston & Bird’s financial services and practices group and the consumer financial services team in Washington, D.C. Johnson started as the CFPB deputy director after serving in the position in an acting role since July 2018. Johnson first joined the bureau in December 2017 as senior adviser to the director and was named the principal policy director in April 2018. Prior to working at the CFPB, he spent over five years with the House Financial Services Committee in various capacities, including senior counsel, chief financial institutions counsel and policy director.
In this first ACA Huddle, Johnson will join ACA CEO Mark Neeb, Vice President and Senior Counsel of Federal Advocacy Leah Dempsey, Vice President-Legal and General Counsel Issa Moe and Corporate Counsel Colin Winkler.
Neeb, who was named ACA’s CEO in 2018, brings to the association nearly 40 years of corporate strategy experience, including 28 years specifically working in the credit and collection industry. Neeb is intimately familiar with ACA, having been a member for many years and serving as ACA president from 2011 to 2012. Since joining ACA, Neeb has been part of the advocacy team working with the CFPB on the proposed rule, including speaking at the bureau’s debt collection town hall in May 2019 when it was announced.
A well-known Washington, D.C., insider, Dempsey has focused on advocating with the CFPB long before joining ACA in May 2018. Since then, Dempsey has led ACA’s efforts with the CFPB through filing comments, organizing meetings, and ensuring the association has had a seat at the table in regulatory discussions and those at the congressional level. Dempsey helped prepare witnesses representing ACA at a House Financial Services Committee hearing on the proposed debt collection rule and has successfully led advocacy efforts surrounding numerous CFPB rules and related congressional initiatives in her career.
Moe is a veteran attorney and regulatory expert, having served as both outside defense counsel for several ACA members, and general counsel and chief compliance officer for an ACA member agency prior to joining ACA. Moe will lend his extensive experience serving in legal and compliance leadership roles within the ARM industry, as well as his experience with Fair Debt Collection Practices Act and Fair Credit Reporting Act cases to this webinar.
Winkler, who works closely with Moe and ACA’s compliance analysts, will present an update on their efforts and an initial compliance outlook for the debt collection rule during the webinar. As corporate counsel, Winkler also supports robust judicial advocacy on the industry’s behalf.
