Drinker Biddle’s “The TCPA in 2018: There and Back Again” features expert legal, regulatory and congressional panelists to discuss changes in the law over time.

ACA International’s Vice President and Senior Counsel of Federal Advocacy Leah Dempsey will share her expertise on the Telephone Consumer Protection Act and its impact on the accounts receivable management industry during a half-day event hosted by the Drinker Biddle Law Firm in Washington, D.C. Nov. 14.
Dempsey will speak on a panel “Where Do We Go From Here: The Evolving Regulatory Landscape, ” to discuss the future of the TCPA and where legislators and regulators may turn with insights from Joseph Wender, office of U.S. Sen. Edward J. Markey, D-Mass; Mary Ellen Kleiman, National Association of Chain Drug Stores; and Jonathan Thessin, American Bankers Association at 2:15 p.m. Eastern Nov. 14.
Following the U.S. Court of Appeals for the District of Columbia decision in ACA’s lawsuit challenging the Federal Communications Commission’s 2015 TCPA Declaratory Ruling and Order and the recent decision by the Ninth Circuit Court of Appeals in Marks v. Crunch San Diego, LLC, according to Drinker Biddle, the “FCC appears poised for the first time in many years to narrow its interpretation of the statute. That, of course, could cause Congress to revisit the scope of the statute as well.”
“Interpretation of the TCPA has a significant impact on the accounts receivable management industry and I look forward to being a part of the panel discussion among legislators and regulators in Washington,” Dempsey said.
Additional discussions slated for the event include:
- “Where Are We and How Did We Get Here?” It’s hard to know where you’re going if you don’t know where you’ve been. The opening session at 2 p.m. Eastern, led by Drinker Biddle partners Laura Phillips and Michael Daly, will provide a brief look at the legislative, regulatory, and judicial history of the TCPA.
- “An Ounce of Prevention: Best Practices for Mitigating Risk,” moderated by Marsha Indych of Drinker Biddle. Sometimes the best defense is just having a defense, and that is certainly true when it comes to the TCPA and Do-Not-Call restrictions. The third session, at 3:15 p.m. Eastern, will focus on defense and compliance strategies designed to minimize exposure from outreach campaigns, with suggestions and war stories from William Maxson, assistant director, the Federal Trade Commission (a recent panelist during ACA International’s seminar on Call Blocking and Labeling;) Mark Mallah, LiveVox; Melissa Bateman Fitzgerald, Gryphon Networks; and Brad Andreozzi, Drinker Biddle.
- “A Pound of Cure: Current Trends in TCPA Litigation,” at 4:30 p.m. Eastern moderated by Justin Kay of Drinker Biddle. While the number of newly-filed TCPA cases decreased from 2016 to 2017, there are still thousands of these cases being filed and litigated. The session will include discussion of litigation trends in 2018 with thoughts from Peggy Daley, Berkley Research Group; Robert DeWitte, KCC; Hassan Zavareei, Tycko & Zavareei LLP; and Matt Fedor, Drinker Biddle.
