ACA Updates SearchPoint Documents on Statute of Limitations and TCPA

The updates include language for West Virginia and case law related to the TCPA.
ACA International has updated documents in the ACA SearchPoint library available for members:
- Statute of Limitations (#1122); Updated disclosure language for West Virginia for debts beyond the statute of limitations.
- TCPA and the Junk Fax Protection Act (#9517); Added Bais Yaakov of Spring Valley v. FCC (D.C. Cir.) Vacating FCC’s 2006 Fax Order in part.
- Statute of Limitations: Collecting Out of Statutes Debts (#1119); Added case law on settlement offers and “will not sue” disclaimers in collection letters for out-of-statute debt (see footnotes 20-26 and corresponding text.) Added analysis of U.S. Supreme Court regarding filing proofs of claim on out-of-statute debts (see footnotes 29 and corresponding text.) Updated disclosure for West Virginia.
