ACA Updates SearchPoint® Documents on Bankruptcy and Licensing

ACA International’s compliance department has updated the following ACA SearchPoint® documents available for members:

Duty to Screen for Bankruptcy (#1156); Content reviewed for accuracy and currency, no substantive changes.

Canada: Nunavut Collection Laws (#2509); Updated contact information for licensing authority, requirements for communications/prohibited practices and requirements for agency operations.

Other recent ACA SearchPoint updates include:

Regulation E (#2330); Content reviewed for accuracy and currency—added guidance from Consumer Financial Protection Bureau Compliance Bulletin 2015-06—Requirements for Consumer Authorizations for Preauthorized Electronic Fund Transfers.

Bankruptcy and Co-Signers (#3035); Reviewed for accuracy and currency—no substantive changes.

Bankruptcy and Pre-Petition Checks (#1175); Reviewed for accuracy and currency—no substantive changes.

Canada: Newfoundland and Labrador Collection Laws (#2506); Updated website address, added link to application form. Reviewed for accuracy and currency—no substantive changes.

Canada: Nova Scotia Collection Laws (#2508); Updated the following sections: contact information, website, address, fees, penalties, and statutes of limitation for civil actions.

States that Require Collection Agencies to Prominently Display License (#2042); Updated for accuracy and currency—removed repealed provision for New Mexico.

Discharging Student Loans through Bankruptcy (#8051); Reviewed for accuracy and currency—no substantive changes.

The Pintos Decision and Permissible Purposes (#1163); Updated to include new case law related to permissible purposes. See new subsection on judgments (footnotes 3-7 and associated analysis).

Permissible Purposes under the FCRA (#1154); Added two new subsections on judgments and fraudulent debts (see footnotes 7-10 and 17-20 and associated analysis). Reviewed for accuracy and currency.
