ACA International’s Minneapolis-based compliance department is the backbone of the association and will become increasing important next year when the Consumer Financial Protection Bureau’s final rule updating the Fair Debt Collection Practices Act is released. Headed by Corporate Counsel Kari Barber, this team of industry veterans will help you understand nuances of the CFPB’s final rule or other state and federal regulatory policy issues so that you can avoid spending your time interpreting dense, confusing language.

Tune in today to hear the inaugural episode of “ACA Cast: Getting to Know the ACA Compliance Department,” featuring Barber, who is interviewed by well-known industry leader Wendy Badger, chief compliance officer, vice president, and corporate compliance at ECMC, in Minneapolis. Barber and Badger engage in a thoughtful exchange about debt collection policy, case law and other information crucial to running a compliant business.

And, if you are like many ARM professionals who spent the summer studying the CFPB’s proposed debt collection rule and preparing your comments, you are likely relieved the Sept. 18 deadline has passed. As the industry anxiously awaits the final rule, Barber said the industry’s chief challenge going forward is — “downright uncertainty from Washington D.C.”

While everyone has focused on rulemaking, Barber cautioned that the courts have continued to rule on relevant cases and “we can’t lose sight [of issues such as] individual state privacy laws where we are continually seeing inconsistent case law.”

There is more to learn on these topics and others in this podcast, and in the upcoming episodes featuring compliance analysts Andrew Pavlik and Laura Dadd. Along with Barber, Pavlik and Dadd are the talented staff members responsible for developing and maintaining ACA SearchPoint documents, ACA Guides to the FDCPA, Fair Credit Reporting Act and the State Guide to Collection Laws and Practices, among other critical pieces of industry news and case law developments. And, if you’ve contacted the “Compliance Officer of the Day,” you may have worked with one of these exceptional professionals.
