11:50 AM - 12:35 PM Session Details

Members Only - It’s been 6 years since New York passed their debt collection rules for initial collection letters. Since then, there have been thousands of lawsuits filed against ACA members about the interpretation of those rules. Find out the latest case law from New York, as well as other lessons the industry has learned before the CFPB proposed rules are published. In the same session, you’ll also hear about how collecting time-barred debts has become a minefield. Do you have to tell a consumer the age of the debt?; whether she "will not" (or "cannot") be sued "because of" the age of the debt? or that a partial payment "might" revive a claim for some or all of the out-of-statute obligation? or whether (and how) any response might affect her credit-worthiness? Not only have all of these questions fueled hotly contested litigation across the country, they also stand to be addressed by the CFPB in a supplemental proposed rulemaking that will remain open for comment through August 4, 2020 (recently extended from a previous deadline of June 5). This session will examine the regulatory and litigation landscape regarding attempts to collect potentially out-of-statute debts and the potential pitfalls when it comes to designing form correspondence and training collection specialists.

Danger Ahead: Unintended Consequences of AI and How to Protect Yourself

3:20 PM - 4:00 PM Session Details

Artificial Intelligence and Machine Learning are making their way into the mainstream for Debt Collection. AI models can predict which consumers are most likely to pay, the channel that is most likely to influence a consumer, identify potential agent strengths, and monitor compliance from speech data, all with relatively high accuracy. You would not employ a model that determined who paid based on race or gender, but what if the model you utilize implicitly segments by national origin? In addition to the negative publicity protected class infringement can cause, implicit bias can be costly - recent lawsuits based on settlement letters sent with an unseen bias have resulted in a settlements costing millions of dollars. The goal of this session is to inform the industry on safe, compliant use of machine learning. To achieve this goal, this session will: •Look at the potential dangers of employing machine learning models and ways to avoid them. •Discuss different model types, from completely transparent to black box, and how they affect usability. •Walk through how to measure the level of implicit bias across protected classes in ML models and strategies for mitigation.
