1. A Ship Adrift: Navigating the Three “C’s” – Convenience Fees, Collection Fees and Costs - This presentation will address best practices under the FDCPA and state law from a compliance and legal perspective to draft collection communication regarding convenience and collection fees. 2. Defending and Preventing Collection Notice Lawsuits - The last two years have seen a significant increase in lawsuits based upon collection notices. This development is particularly concerning as collection notices frequently support class certification. This presentation will cover not only recent court decisions, but also strategies and tactics for defending the suits and preventing them in the first place. 3. Bankruptcy Litigation after Midland Funding v. Johnson: Another deluge or just a drop in the bucket? - In Midland Funding v. Johnson, the Supreme Court held that proofs of claim for out-of-statute debts are not actionable under the FDCPA. But the Supreme Court did not hold that bankruptcy proofs of claim are immune from FDCPA claims. And in Johnson’s wake, debtors and their attorneys are exploring their options both for contesting the allowance of proofs of claim and for asserting new affirmative claims for relief, including under the FDCPA. This presentation will review bankruptcy litigation and other issues after Johnson, and discuss potential strategies for creditors and debt collectors. 4. Recent U.S. Supreme Court FDCPA Decisions and the Pantoja Circuit Split - Last year, the U.S. Supreme Court decided two FDCPA cases in favor of the debt collection industry. In the most recent term, the Court was again asked to resolve a circuit split regarding FDCPA claims. In particular, a debt collector sought to apply the rationale of Midland Funding, LLC v. Johnson to dunning letters seeking payment of time-barred debt. This presentation will examine the claims at issue, discuss the arguments and decisions leading to the circuit split. If certiorari is granted in the case, the panel also will analyze the arguments at the Supreme Court, including the potential impact of the Midland Funding decision from early 2017. The implications of the circuit split could range from whether debt collectors can even attempt to collect time barred debts (reading Johnson to its narrowest of holdings regarding proofs of claim) to, at bottom, requiring debt collectors to revamp all letter correspondence and collections call scripts and strategies. 5. Turning the Tables – Setting Up Your Cases to Win Sanctions - Be prepared for that golden opportunity when a Plaintiff, or his/her counsel, presents you with a viable opportunity to pursue sanctions against them! This presentation will discuss the best practices for your clients and your firm to position yourselves to pursue sanctions when possible, and will discuss moving for sanctions in three different scenarios: under the federal Rules of Civil Procedure, when defending an FDCPA case, and defending a FCRA case.
