A collection agency recently filed a class action complaint against five New Jersey attorneys for running a "mafia-style racketeering" operation that targets collection agencies under consumer protection statutes in order to extort settlements and attorneys’ fees. Sound familiar? This seminar will take a closer look at the claims and strategy behind the Collection Solutions, Inc. v. Jones lawsuit. FDCPA claims and the CFPB’s proposals on debt collection are causing increased problems for debt buyers, collection agencies and collection attorneys in the context of consumer bankruptcies. Filing proofs of claim, pre-petition and post-petition actions can all give rise to FDCPA and other consumer claims in the course of a bankruptcy. Join us while we unravel the mystique of bankruptcy, discuss how to navigate the uncertain waters of the CFPB’s proposed guidance on debt collection, discuss the ways FDCPA claims can present themselves in bankruptcies, and our best weapons for defending against them. We will also take a look back at the Eleventh Circuit’s 2014 decision in Crawford v. LVNV Funding and its implications moving forward, including the United States Supreme Court's recent agreement to hear Midland Funding v. Johnson.

(Legal Track) Wi-Fi Cell Phone Services & the TCPA

Recently, Wi-Fi cell phone providers (such as Republic Wireless and Google’s Project-Fi) have issued cell phone numbers to subscribers that includes an underlying national cell network provider number that is unknown to the subscriber. When a consumer calls into a debt collector and states they’ve received a phone call, the number given by the consumer does not appear in the debt collector’s system as the consumer is unaware that the collector was calling the underlying number. The debt collector is unable to mark the number as bad or cease calling upon request. The implications for both TCPA and FDCPA liability become apparent. In this presentation, we will highlight the issue, how to recognize it and discuss potential preventative measures. Potential defenses under the TCPA and FDCPA will also be discussed.

ACA vs. FCC Decision: What Does it Mean for the Industry?

ACA International v. FCC - This case is ACA’s closely-watched consolidated appeal from the FCC’s landmark 2015 Omnibus Declaratory Ruling and Order on the Telephone Consumer Protection Act. Within hours of the TCPA Order’s release, ACA was first to file suit against the FCC. ACA’s appeal challenges whether the FCC exercised its regulatory authority appropriately or if the agency ignored a controlling statute in order to expand the scope and reach of the TCPA in a way that Congress never intended, leaving a law in place that hurts legitimate, law-abiding businesses. The highly anticipated decision in the ACA Int’l case is excepted to resolve some of the most controversial interpretations of the TCPA issued by the FCC. Hear first-hand from the lawyers directly involved in the case, including ACA’s appellate counsel, Brian Melendez of Dykema Gossett, and ACA’s corporate counsel, Karen Scheibe Eliason. On a bright January afternoon, US Airways Flight 1549 accelerated down New York La Guardia Airport’s main runway. In the air, First Officer Jeff Skiles spotted a formation of Canadian geese almost directly ahead. In a matter of seconds, the birds impacted the aircraft. Both engines immediately failed. Together with Captain Chesley Sullenberger, they decided that returning to LaGuardia was simply not possible—they’d have to fly over densely populated areas and there was no guarantee that they’d make it. When a consumer calls into a debt collector and states they’ve received a phone call, the number given by the consumer does not appear in the debt collector’s system as the consumer is unaware that the collector was calling the underlying number. The debt collector is unable to mark the number as bad or cease calling upon request. The implications for both TCPA and FDCPA liability become apparent.
